By submitting this form, you (“you” or “Applicant”) confirm you have read and agree to the following terms. The following terms and conditions form a legally binding agreement between Cininfo tech Private Limited (“Cininfo”) and you (“Agreement”) and the parties hereby agree that no part of this Agreement shall be read or construed in favour of or against any party.
- Applicants must be Cininfo Subscribers (membership verified via ID).
- All submissions will undergo a thorough review by our selection panel. Only shortlisted applicants will move forward to the pitch round and final selection.It is hereby clarified that Cininfo disclaims any liability or implied warranty with respect to the selection of the scripts of any candidate. Selection of scripts/ candidates shall be subject to the sole and absolute discretion of the selection panel and Cininfo shall not be held liable for the same.
- Only registered scripts and public viewable links will be accepted in the application form. Unregistered scripts or private links will not be considered.
- Once your application is submitted, no further edits or changes will be allowed.
- Shortlisted candidates selected for the pitching session will be required to pay a participation fee of $120
- The application fee is a one-time, non-refundable fee, valid for one project only and shall not be returned under any circumstances, including but not limited to withdrawal, cancellation, or rejection of the application.
- Mentors will select their mentees based on the application submission and their online Live Pitch. Applicants will not be allowed to choose their mentors in advance.
- The Applicants will provide high-quality images and video content (as reasonably requested) for the creation of promotional and marketing materials (“Collaterals”), allowing their name, likeness, professional profile, and contributions to be featured in approved Collaterals.
- You are the sole author of the submitted synopsis/storyline/ script submitted (hereinafter referred to as “Synopsis”) and hereby represent and warrant that the synopsis/storyline/ script submitted by you does not infringe intellectual property rights of any third party and you will be the sole representative to attend the CininfoLaunchpad 2025 with regard to the Synopsis.
- In the event you are selected for Cininfo Launchpad 2025, youshall develop and submit a detailed script draft to the CININFO Launchpad 2025 as per the timelines prescribed by CININFO.
- The Story, Screenplay. Dialogues, Synopsis, Script and step outline shall be collectively hereinafter referred to as “Literary Work(s)”.
- In the event that you are selected for the Cininfo Launchpad 2025, You shall make yourself available to attend the sessions of the Cininfo Launchpad 2025, as specified by Cininfo and shall ensure that any paperwork required for the same shall be duly processed by you.
- You hereby expressly agree and abide that once your Synopsis is selected, during the course of the Cininfo Launchpad l, you shall not agree to sell, assign, transfer, create any lien, encumbrance or any other rights whatsoever in nature in favour of any third party/person/s on the Synopsis and/or the Script without the prior written consent of Cininfo Launchpad team.
- In the event youparticipate in the first session of the Cininfo Launchpad 2025 and/or do not submit the revised Script/Step-outline within the prescribed timelines set for the second session of the Cininfo Launchpad 2025 without taking prior written consent from Cininfo in such event you would be disqualified to participate in the further session of the Cininfo Launchpad 2025 due to non-compliance with Cininfo – rules and regulations, then without prejudice to rights and remedies of Cininfo – in law and equity, and
- Youagree and confirm that Cininfo Launchpad 2025 is not a contest, and there are no prizes or awards instituted for the same.
- Youagree and confirm that the project document(s) submitted by you to Cininfo – may be rendered accessible to the third-party partners and evaluation committees associated with Cininfo – as well as the participants and consultants participating in the Cininfo Launchpad.
- In the event the project document(s) called upon is sent to the aforementioned parties electronically via e-mail, as an applicant, you areaware of the consequences and the risks involved with electronic correspondence by e-mail. Particularly, the transmitted messages can be unwittingly lost or read, received, copied or falsified by outside parties, which may result in considerable damage. You shall allow Cininfo to communicate written email correspondence relating to the above-mentioned evaluation and all matters associated with the Cininfo Launchpad 2025 , as well as to send project documents by e-mail to the applicant as well as with the consultants participating in the Cininfo Launchpad 2025.
- Youagree and confirm that the Cininfo will not be responsible for the submissions that are lost, stolen or damaged during transit. Once selected, you agree and confirm to submit the final/shooting Script, which is the outcome of the Cininfo Launchpad 2025 to Cininfo for record purposes.
- You agree and confirm that Cininfo is a market to enable film industry professionals to promote their projects and make valuable business contacts in the emerging film market of South Asia. You further agree and confirm that the role of Cininfo is limited to holding and organising a platform for the professionals in their interest and for the purposes specified above. Therefore, in view of the above, you agree and confirm that if any dispute arises in relation to your script submitted to Cininfo, including but not relating to infringement of Copyright or otherwise, You shall not to be entitled to make any relief /claim against Cininfo and shall only initiate a claim against the concerned person/s individually before the appropriate forum, for which Cininfo shall not be liable.
- The Applicants shall support promotional efforts by accepting and responding to collaboration or tag requests on social media and digital channels initiated by Cininfo, including but not limited to Instagram, LinkedIn, YouTube, Facebook, press releases, and other platforms used by Cininfo.
- The Applicants grant Cininfo the right to record, live-stream, webcast, and otherwise publicly transmit the pitching show and other events or appearances, and to use and reproduce the recordings in part or whole for marketing, educational, and promotional purposes across any current or future Cininfo channels. The Applicant hereby acknowledges and agrees that the Applicant’s appearance/ performance in the program and the product of the services rendered by the Applicant in relation to the program are and shall be deemed to be “commissioned work” within the meaning of the Copyright Act, 1957 and shall be deemed to be “works-for-hire” and shall be owned by Cininfo or the entity commissioning Cininfo, throughout the world and in perpetuity. The Applicant hereby permits, allowsand grants Cininfo and its authorised representatives to record his/her performance, work and appearance in relation to the program on any related series of sounds and images as specified herein on film, tape, or digital or other electronic media and also grant and permit the right to broadcast any such recording, or otherwise transmit, broadcast the same through any media whatsoever, with or without sound, including without limitation, spoken words, dialogue(if any), lyrics and music synchronously recorded and to communicate any material in which any rights subsist in whole or in part by any means now known or later devised, perpetually and worldwide.
- The Applicants hereby grant Cininfo and its authorized partners a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to:
- Record, use, distribute, and display the Applicant’s image, voice, and likeness as captured during any Cininfo Launchpad events, including any webinars and pitching shows.
- Stream and/or reproduce said recordings across digital and broadcast platforms including, but not limited to, Zoom, LinkedIn, YouTube, Instagram, Facebook, and other channels operated by or affiliated with Cininfo.
- Edit, adapt, and incorporate such recordings into promotional content, subject to Cininfo’s discretion and brand guidelines.
By participating in the Cininfo Launchpad, the Applicant acknowledges and agrees to the aforementioned responsibilities and consents to the described usage of their image, voice, and content for promotional and marketing purposes by Cininfo.
The Applicant hereby grants to Cininfo the exclusive right in connection with the program to use his/her image, name, sobriquet, autograph, photograph, portrait, caricature, voice, silhouette biography and photograph (still and video) and/or likeness in any manner or media now known or hereinafter devised, including without limitation, in sound recordings, merchandising, commercial tie ins, theme parks and stage shows throughout the universe in perpetuity including for advertising, publicizing, promoting or otherwise exploiting the program. Any royalties payable by the operation of law (if any) in India for any performances may be collected by the applicable registered copyright society in India of which he/she is a member, at rates prescribed by the applicable laws and subject to any judicial and/or quasi-judicial decision, provided that the applicable provisions under the Copyright Act, 1957 (as amended) with respect to payment of royalties to performers remain in force.
The Applicant acknowledges, understands and agrees that participation in the program may involve activities that are or may become hazardous and dangerous and/or that may expose him/her to risks of physical, emotional, and mental stress or injury. The Applicant represents and warrants that he/she does not have any existing medical condition. The Applicant understands and assumes the risk of participating in the program, and releases Cininfo, entity commissioning Cininfo, its assignees and their employees, agents and contractors from any and all liability for the same. To the maximum extent permissible in law, Cininfo or any entity related to the program, shall not be responsible in any manner whatsoever to him/her and/or to his/her heirs, legal representatives in case of death or injury of any kind caused to me at the time of shooting, travelling, at the venue and/or participating in the program. The Applicant hereby allows Cininfo to conduct any medical and health evaluations as Cininfo may deem necessary.
The Applicant hereby agrees and undertakes not to disclose/publicise any Confidential Information including any material, details in connection with the shooting/production of the program, in any manner whatsoever until the program is utilized publicly by Cininfo. The Applicant understands and acknowledges the necessity maintaining confidentiality in respect of the Confidential Information, contents of the program confidential until the program/Confidential Information are made public by Cininfo. Without prejudice to the foregoing, the Applicant undertakes not to (i) make any recordings or click photographs of the shoot without the express written authorization of Cininfo using any personal camera or other device; (ii) post any photographs or information about the Confidential Information which is not publicly known through any mode or medium including social media. The Applicant shall not make any statements, comments, disclosure which may be prejudicial to the goodwill, business and/or image of Cininfo, its affiliates, the program, in any manner whatsoever or which may be considered disparaging, negative, obscene, indecent or defamatory.
For the purpose of this clause, “Confidential Information” shall mean and include any and all information relating to Cininfo and/or the program including but not limited to the creative works in relation to the development of the program, protagonist participants, script/concepts(if any), music of the program, persons/entities involved/participating in or associated with the program, any other information or documents, whether or not explicitly designated as “confidential”, disclosed or to be disclosed (including information transmitted in written, electronic, magnetic or other form and also information transmitted orally, visually or by other means) and any and all information which may be developed or created, in whole or in part, directly or indirectly, from such information as well as commercial, financial, technical data, data relating to the business of Cininfo, including data relating to the Cininfo’s employees, non-public information regarding the program, service providers and mentors.
In case of breach of any of these terms and conditions by the Applicant, without prejudice to the other rights and remedies Cininfo may have under law, equity or otherwise, such Applicant shall be liable to pay damages to Cininfo.
Cininfo reserves the right to amend these terms of the program without prior intimation and the Applicant agrees and confirms to be bound unconditionally and completely by the revised terms.
The Applicant hereby agrees to indemnify, defend and hold Cininfo harmless against all claims, penalties, losses, damages, liabilities, costs or expenses (including attorneys’ fees and other dispute resolution costs) and compensation (“Loss”) that may be incurred by Cininfo arising out of, involving or relating to, either directly or indirectly, any inaccuracy in any of my representations or warranties or any breach of any covenant or obligation set forth in this Agreement.
